These Terms of Use ("Terms") govern your access to and use of the Judgeworthy website (the "Site"), operated by Irvin Group, LLC ("Irvin Group", "we", "us"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

Use of the Site

The Site provides information about our services and a means to contact us. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • use the Site in any way that violates applicable law or regulation;
  • attempt to gain unauthorized access to any part of the Site, its servers or connected systems;
  • introduce viruses, malicious code or any material that is technologically harmful;
  • use automated means to scrape, harvest or collect content or information from the Site beyond what search engines do in the ordinary course of indexing;
  • impersonate any person or entity or misrepresent your affiliation; or
  • interfere with the proper working of the Site.

No engagement through the Site

Information on the Site is provided for general information and does not constitute an offer capable of acceptance. Services are provided only under a separate written agreement signed by both parties, which will govern in the event of any conflict with these Terms. Submitting an inquiry through the Site does not create a client relationship.

Intellectual property

The Site and its content, including text, graphics, logos, and software, are owned by Irvin Group or its licensors and are protected by copyright, trademark and other laws. You may view, download and print pages from the Site for your own internal business use, provided you keep all copyright and proprietary notices intact. Any other use, including reproduction, modification, distribution or republication, without our prior written consent is prohibited. "Judgeworthy" and associated logos are trademarks of Irvin Group, LLC.

Third-party product names mentioned on the Site (including tool and platform names) are trademarks of their respective owners. Their mention does not imply endorsement, sponsorship or affiliation.

Submissions

Any information you submit through the Site's contact form or by email is subject to our Privacy Policy. You represent that you have the right to provide any information you submit and that it does not infringe the rights of any third party. Do not submit confidential information through the Site; if we proceed to an engagement we will put a confidentiality agreement in place.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Content on the Site, including articles and descriptions of testing methods, is general information and not professional advice for your specific situation. Nothing on the Site constitutes a certification, attestation or guarantee regarding the safety, security or performance of any AI system.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IRVIN GROUP AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to their jurisdiction.

Changes

We may revise these Terms at any time by posting an updated version on the Site. The effective date at the top indicates when they were last revised. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

General

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Irvin Group regarding use of the Site.
